BJ's MEMBERSHIP TERMS

We are pleased that you have become a Member of BJ’s Wholesale Club, Inc. (“BJ’s” or “we”) and look forward to serving you. The Terms, Types and Features of BJ’s Membership (these “Terms”) are described below and are always available at BJs.com/terms or at the the Member Services Desk of any of our Clubs. For purposes of these Terms, Member shall mean an individual or business enrolled in any of the Membership types listed herein.

Membership. Membership is nontransferable and available to those 18 years of age or older. BJ’s reserves the right to require valid government-issued identification for Membership enrollments and changes. The Primary Member (or an owner or officer of a Business Membership) has sole authority to make changes to the Membership (including any associated Supplemental Memberships) and to request and receive appropriate information. Notwithstanding the foregoing, a Household Cardholder may upgrade or renew the Membership, as well as apply for a My BJ’s Perks® Mastercard® Credit Card or enroll the Membership in BJ’s Easy Renewal® program. The privileges of Membership – including the use of Membership Cards in our Clubs – are only available to registered Members. Membership Cards are not issued for BJ’s Online Access℠ Members. All Membership Cards remain the property of BJ’s. BJ’s reserves the right to deny Membership to any applicant and to terminate any Membership at its discretion and for any reason. BJ’s cashiers will check Membership Cards at point-of-sale in our Clubs for member validation.

Shopping Privileges. A BJ’s Membership is required to shop on BJs.com or in our Clubs. BJ’s Online Access℠ Membership does not provide Club shopping privileges. BJ’s reserves the right to require that Membership Cards be shown upon entry into any Club. No sales will be made to any person in-Club unless such person has a valid Membership Card or Pass. Each Member with in-Club shopping privileges may bring two guests; however, guests do not have purchasing privileges. Members may be required to purchase any packages they or their guests open or damage. Parents must keep their children with them at all times. BJ’s may refuse entry to anyone at any time and reserves the right to inspect any bag, backpack, briefcase or container upon entry or exit. BJ’s inspects all receipts and carts as Members exit the Club. BJ’s does not offer rain checks for out-of-stock items and reserves the right to limit quantities. BJ’s strictly prohibits solicitation or other disruptive conduct on its premises and may require anyone engaged in such conduct to leave the Club.

Alcohol Transactions BJ’s endeavors to ensure that alcoholic beverages are not sold or delivered to anyone who is under the age of 21 or outside of the United States. You may have the option to order delivery of alcohol products from select BJ’s Club locations and where permitted by law. Alcohol product availability and quantity vary by state due to differing state regulations. Alcoholic sales, including the delivery thereof, are not available for those under the age of 21. A valid proof of age is required for all transactions involving alcohol. Any alcohol purchased from BJ’s must be for personal consumption and not for resale. If you intentionally or unintentionally misrepresent your age in order to obtain or provide alcohol to a person under the age of 21, we will report this to the appropriate authorities, prosecute you fully to the extent allowable by law, and terminate your membership.

Upon any delivery involving alcohol, BJ’s delivery partners (“Driver”) will ask to see the recipient’s valid government-issued ID (e.g., driver’s license) to confirm recipient is 21 or older to receive the order. The recipient will also be required to sign for the order. Failure to provide a valid ID will prevent the Driver from completing the delivery. If the recipient is visibly intoxicated, the Driver reserves the right to refuse to deliver the order. In the event the recipient is unable to sign for the order (i.e., not home), unable to provide a valid ID, or visibly intoxicated, the order will be returned to the Club and your credit/debit card will be refunded.

By using this site to order alcohol, you swear and affirm and represent to us that you (and the recipient) are over the age of 21. If for any reason it is found that you (or the recipient) are under the age of 21, you and/or the recipient agree to indemnify BJ’s and/or reimburse us and be responsible for all costs, expenses (including legal fees) and damages BJ’s suffers or incurs. You also swear and affirm and represent to us that any alcohol purchased from BJ’s is intended for personal consumption and not for resale. If you cannot make these affirmations and representations or you do not agree with all of these conditions of use please do not use this site to order alcohol.

After you place an order for alcohol through this site, we will check the transactional information you give us for validity and compliance with state laws and regulations, by verifying your method of payment or shipping address. We may, at our own discretion, limit or cancel quantities purchased per person, per household or per order. We also reserve the right to reject any order you place with us. These restrictions may include orders placed by the same web site account, the same credit card, and orders that use the same billing and/or shipping address. In the event we make a change to an order, we will attempt to notify you by contacting the e-mail address provided at the time the order was made. We do not sell alcohol to dealers. Your credit or debit card will normally not be charged if we reject an order, but we will process a refund if the charge has been made against your card.

Check Writing. Check writing is subject to the respective bank’s approval. In the event a check remitted to BJ’s bounces, as determined by the bank, it is automatically sent to TRS Recovery Services. TRS Recovery Services will notify the check holder at the address listed on the check that it has bounced and payment is outstanding. All bounced checks are subject to a service fee as determined by state law, as well as any additional collection fees incurred by BJ’s in order to recoup payment, as necessary. Payment should be made directly to TRS Recovery Services. Questions regarding any bounced checks may be directed to TRS Recovery Services at 1-800-366-1049.

ANY CLAIM ARISING IN ANY WAY OUT OF YOUR BJ’s MEMBERSHIP OR YOUR SHOPPING IN BJ’s CLUBS OR ON BJs.COM WILL BE GOVERNED BY MASSACHUSETTS LAW. EITHER YOU OR BJ’s MAY ELECT THAT ANY SUCH CLAIM BE RESOLVED SOLELY BY BINDING ARBITRATION UNDER THE RULES AND PROCEDURES OF THE AMERICAN ARBITRATION ASSOCIATION. THERE SHALL BE NO RIGHT OR AUTHORITY FOR ANY CLAIMS TO BE ARBITRATED ON A CLASS-ACTION BASIS.

Membership Expiration and Renewals. The month and year in which your Membership expires appear on your register receipts, and on your “My Account” page on BJs.com. Your Membership expires on the last day of the month and year shown. Paid Memberships renewed within two months after expiration will be extended 12 months from the expiration date. Paid Memberships renewed more than two months after expiration will be extended for 12 months from the last day of the month of renewal. If you do not renew your BJ’s Membership, a non-Member surcharge (equal to 20% of your total purchase for in-Club purchases and $5 per purchase on BJs.com) will apply to all of your post-expiration BJ’s purchases. Expired Members that do shop and pay a surcharge may come back to the Membership Desk at any Club location to apply the surcharge paid toward their Renewal fee within seven (7) days from such surcharge, up to the Renewal fee.

BJ’s may change these Membership Terms at any time, without notice to you. If any change is found void or unenforceable, that change is severable and does not affect the validity of the remaining terms. Your continued use of your Membership at BJ’s Clubs or on BJs.com constitutes your acceptance of the changes. If you do not agree to such changes, you must cancel your Membership.

BJ’s MEMBERSHIP TYPES

Promotional Membership. BJ’s offers no-cost or low-cost, limited-length (e.g., 60-Day) Memberships from time to time. Promotional Memberships are by invitation only. Offer must be presented at the time of enrollment. Promotional Membership only provides one Primary Membership Card. Household and Supplemental Memberships may not be added to a Promotional Membership. BJ’s may limit the frequency with which an individual is eligible to enroll in a Promotional Membership.

BJ’s Online Access℠ Membership. BJ’s Online Access℠ Membership provides one Primary Membership for online shopping on BJs.com. BJ’s Online Access℠ Members may not have access to the full range of BJ’s Member Services (including but not limited to cellular phone services, BJ’s Optical Department,® and certain features of BJ’s Travel®) or to the same item selection, pricing, availability or promotions available in our Clubs. To exercise Club shopping privileges or access the full range of BJ’s Services, BJ’s Online Access℠ Members must upgrade to a BJ’s Inner Circle® Membership or BJ’s Perks Rewards® Membership. BJ’s Online Access℠ Membership requires enrollment in BJ’s Easy Renewal® Program, described below. Cancellation of enrollment in the BJ’s Easy Renewal® will result in cancellation of Membership upon expiration of the then-current Membership term. BJ’s Online Access℠ Membership is not eligible for BJ’s Membership Money-Back Guarantee.

BJ’s Inner Circle® (Personal) Membership. BJ’s Inner Circle Memberships provide one Primary Membership Card and a Household Card, provided at no additional charge, that may be issued to a person residing at the same residence as the Primary Member as confirmed by BJ’s. Up to three (3) additional Supplemental Memberships may be purchased for the same household. BJ’s Inner Circle Members in good standing may upgrade their Membership to a BJ’s Perks Rewards® Membership.

BJ’s Business Membership. Business Membership provides one Primary Business Card and one Business Free Supplemental Card, provided at no additional charge, that may only be issued to a business associate. Business Members may purchase up to eight (8) additional Supplemental Cards. (A “business” is defined as one business address.) BJ’s Business Members in good standing may upgrade their Membership to a BJ’s Perks Rewards® Membership. If the BJ’s Business Member (a) intends to purchase merchandise for resale and claim an exemption from sales tax or (b) is purchasing merchandise on behalf of an exempt organization, then BJ’s must have a valid, signed state Resale Organization Certificate or valid, signed state Exempt Organization Certificate, respectively, on file at the Club of Membership. The Member must accurately complete the Supplemental Certificate of Resale or Exempt Organization Certificate provided by the cashier at the time of purchase. The Primary Member shall immediately notify BJ’s if the Resale Certificate on file is invalid or if the description of products to be resold has been changed. BJ’s may require confirmation of exemption or a Resale Certificate at its discretion. In the states of CT, ME and RI, all purchases by tax-exempt organizations must be paid by organizational check or credit card. In the states of FL and NY, all purchases by tax-exempt organizations must be paid by an organizational check, credit card or cash. BJ’s does not sell alcoholic beverages for resale except in the state of ME. The Primary Member agrees that in the event the Primary Member or any Supplemental Card holders fail to pay sales tax, all will hold harmless and indemnify BJ’s Wholesale Club, Inc. and its affiliates from and against any claim, loss or expense arising out of such nonpayment, and BJ’s reserves the right to suspend or terminate the corresponding Membership in such case.

Military Membership. Active and veteran US Military personnel may enroll in-Club at a reduced Membership fee. Active military ID, “Veteran” designation on state-issued ID, or other proof of service is required. Military Membership has the same rights and privileges as a BJ’s Inner Circle® Membership.

College Membership. A College Membership provides one Primary Membership Card. Up to three (3) additional Supplemental Memberships may be purchased for use by a person residing at the same residence as the Primary Member. No Household Card is available to College Members. BJ’s requires valid school-issued identification for College Membership enrollments. College Members may not upgrade their Membership to a BJ’s Perks Rewards® Membership and are not eligible to apply for the My BJ’s Perks® Mastercard® Credit Card or Special Offers.

BJ’s Perks Rewards® Memberships. BJ’s Perks Rewards® Membership offers all the rights and privileges of BJ’s Inner Circle® or Business Membership, plus the ability to earn 2% cash back on Eligible Purchases, unless the Primary Member is a My BJ’s Perks® Mastercard® Credit Card holder, in which case the Membership will only earn cash back if the card is used and in accordance with the My BJ’s Perks® Mastercard Credit Card Program Terms. Members may only enroll in one BJ’s Perks Rewards® Membership. “Eligible Purchases” means purchases at BJ’s Club front-end registers and on BJs.com. Eligible Purchases do not include BJ’s in-Club purchases of exempted items restricted by law or regulation; sales taxes; bottle deposits; alcoholic beverages; cigarettes or tobacco-related products; lottery tickets; gift cards; propane; gasoline; BJ’s Member Services (such as BJ’s Auto Buying Program,® cellular phone services, BJ’s Optical Department,® BJ’s Travel®); purchases through delivery.BJs.com; other purchases not recorded through BJs.com or in-Club front-end registers; or as posted at the Member Services Desk. Cash back is issued in the form of digital Awards that are issued in $20 increments when your BJ’s Perks Rewards® balance reaches $20. Awards will become available within 2-3 business days after your balance reaches $20. Cash Back can be requested in the form of a check prior to Awards expiring by contacting Member Care at 800-BJs-CLUB. The Primary Member and Household Cardholder may elect whether to share Awards with one another. When Awards become available, the Primary Member and Household Cardholder or Free Business Cardholder (as applicable) may choose to redeem or save them for later use. Supplemental Members do not earn and may not redeem Awards. Awards may be used for merchandise and Membership fees at checkout at BJ’s. If you choose to use Awards on an in-Club purchase, you must use all the Awards that are presented to you. If you choose to use Awards at checkout on BJs.com, you may choose how many $20 increments of available Awards you wish to use. Each Award may only be used once and for one purchase. Use of Awards will not create a negative cash register or checkout balance, and Awards cannot be combined from multiple Memberships. Cash back can be requested in the form of a check prior to Awards expiring by contacting Member Care at 800-BJs-CLUB. If you make a return on a purchase on which you redeemed Awards, your Awards will be refunded as follows:

• In-Club. If the total cost of your purchase, after the return, still exceeds the value of any redeemed Awards, no Awards will be refunded to you. Otherwise, the purchase price, including the value of any Awards redeemed, will be refunded either to the form of tender on which the greatest portion of the original purchase was charged or to a BJ’s gift card, in BJ’s discretion.

• On BJs.com. Awards are applied pro rata to all items in an Eligible Purchase made online. A return of any item will result in a corresponding credit of the pro rata Awards amount to your Program Balance.

Awards are redeemed on a “first in, first out” basis, such that the first Award earned will be the first redeemed. Your BJ’s Perks Rewards® balance is shown on your register receipts and your “My Account” page on BJs.com. Awards earned may not exceed $500 in any 12-month period. Only one Membership may earn Awards in each transaction. We reserve the right to verify and adjust your BJ’s Perks Rewards® balance. Awards expire six (6) months from the date issued. Once Awards expire, they may not be redeemed. Your BJ’s Perks Rewards® balance will be reduced by the number of Awards issued. Purchases that are returned or refunded or otherwise adjusted will be deducted from your BJ’s Perks Rewards® balance. Such deductions may result in a negative BJ’s Perks Rewards® balance, in which case, any future earnings will be applied to reduce that negative balance. Awards cannot be purchased or sold and are not transferable. If you believe BJ’s failed to properly credit you with BJ’s Perks Rewards® earnings, you must make a claim for such missing earnings within ninety (90) days of the date on which the purchase giving rise to such earnings was made. Any missing BJ’s Perks Rewards® earnings not claimed within such time period shall be forfeited. My BJ’s Perks Rewards® Memberships may only be downgraded at the time of renewal either at Member Care or at a Membership Desk at which time you will forfeit any partial BJ’s Perks Rewards® balance and will no longer accumulate earnings to your BJ’s Perks Rewards® Balance; however, you may continue to use previously earned but unexpired Awards at BJ’s Member Pricing®. If you cancel your BJ’s Membership entirely, any partial BJ’s Perks Rewards® balance will be forfeited. We may, from time to time, make special offers for you to accumulate bonus earnings on specific purchases. Availability of any special offer is subject to change without notice. If you are a BJ’s Perks Plus® Mastercard® or BJ’s Perks Elite® Mastercard® cardholder, other My BJ’s Perks® Program benefits and terms apply to you and can be found at BJs.com/perksterms. BJ’s MEMBERSHIP FEATURES

We Protect Your Privacy. BJ’s respects your right to privacy and our documented Privacy Policy details our practices and policies. We are the sole owner of collected information and we only share this information with third parties in the limited situations described in our Privacy Policy. Please visit BJs.com to read the BJ’s Privacy Policy in its entirety, or call BJ’s Member Care at 800-BJS-CLUB (257-2582) to request a copy.

BJ’s Easy Renewal® Program. Under the BJ’s Easy Renewal® Program, the Membership fee will be automatically charged to the credit or debit card authorized by the renewing Member (unless you are a My BJ’s Perks® Mastercard® Credit Card holder, in which case the My BJ’s Perks® Mastercard® Credit Card will automatically be charged in accordance with the My BJ’s Perks® Mastercard® Credit Card Program Terms). The current Membership fee will be charged on the 1st day of the month in which the Membership is set to expire, and the Membership will be renewed as of its expiration date. The Member who enrolled in BJ’s Easy Renewal® will receive a reminder prior to this renewal charge, specifying the amount and the date of the charge on the billing statement in the month prior to the month of the charge. may enroll in BJ’s Easy Renewal® at any time. If you are enrolled in BJ’s Easy Renewal® as a new Member, all your Supplemental Memberships (including the Household Cardholder) will also be included in BJ’s Easy Renewal.® If you join BJ’s Easy Renewal® at the time of your renewal, all Memberships renewed will be included in BJ’s Easy Renewal.® If you join BJ’s Easy Renewal® while upgrading your BJ’s Inner Circle® or Business Membership to BJ’s Perks Rewards® Membership, only the upgraded Membership will be included in BJ’s Easy Renewal.® You may manage your BJ’s Easy Renewal® participation at the Member Services Desk, on BJs.com or by calling 844-268-8093.

Payment Methods and Coupons. BJ’s accepts Mastercard®, Visa®, American Express® and Discover® Network both at Clubs and for online shopping on BJs.com. Cash, checks, debit cards and EBT are accepted in Clubs. BJ’s accepts manufacturers’ coupons for merchandise purchased at the register in any Club where the product is sold. BJ’s enforces all rules of redemption as stated on coupons. BJ’s reserves the right to limit the number of coupons redeemed per item and per transaction. BJ’s reserves the right to restrict issuance of coupons and publications to selected Members. BJ’s may make certain digital coupons or promotions available for redemption when shopping online at BJs.com available from time to time in its sole discretion. Redemption of such digital coupons or promotions shall be subject to all applicable terms and conditions provided in connection therewith.


Your BJ’s Membership Money-Back Guarantee. Primary Members, other than BJ’s Online Access℠ Members, who are dissatisfied may cancel their Membership at any time and request a refund of Membership fees paid for the current Membership period at all BJ’s Club locations. Any cancellation by a Primary Member can be made at the Club or sent in writing via letter to BJ’s Wholesale Club, Inc., Attn: Membership, 25 Research Drive, Westborough, MA 01581. Refunds will not be paid for second or subsequent cancellations. Cancellation of Primary Membership will cancel Supplemental Memberships. Membership fee refunds will be paid only to the Primary Member. BJ’s Perks Rewards® upgrade fees and fees for BJ’s Online Access℠ Membership are not subject to this policy and will not be refunded.

Gift Cards. BJ’s Gift Cards are redeemable only for Membership fees and merchandise at BJ’s Club front-end registers, and at BJ’s Gas® locations. BJ’s will reissue a lost Gift Card only with the original receipt, which contains the Gift Card number. BJ’s will reissue the remaining balance on record as of the date of requested reissuance.


We Accept Returns. BJ’s selects the highest quality merchandise for our Members and stands behind the products we sell. If you are not completely satisfied with a purchase made online or in-Club, BJ’s will offer you a refund or exchange in accordance with our Return Policy at BJs.com/returnpolicy, which is incorporated into these Terms by reference.
