BJ’s Pick Up in-Club, Curbside Pickup, Same-Day Delivery, and Same-Day Select® Terms

  

BJ’s offers pick up in-club, curbside pickup, same-day delivery services, and Same-Day Select (“SDS”) membership add-ons for members. By using these services, or purchasing and using an SDS membership add on, you are agreeing to these BJ’s Pick Up in-Club, Curbside Pickup, Same-Day Delivery, and Same-Day Select Terms (“Delivery Terms”). These Delivery Terms are subject to the BJ’s Membership Terms (BJs.com/terms) and capitalized terms not defined in these Delivery Terms will have the meaning provided in BJ’s Membership Terms.

Pick Up in-Club and Curbside Pickup

Select products offered on BJs.com and in the BJ’s mobile app are available for pick up in-club or curbside. When you place your pickup order on BJs.com or in the BJ’s mobile app, you will choose a pickup time. BJ’s reserves the right to charge additional fees for priority pickup times and orders under $50 (after discounts, before taxes). BJ’s will use reasonable efforts to hold all orders until one hour before club closing the day after your designated pickup time. If your order has not been picked up within that time frame, your order will be canceled, and you authorize BJ’s to charge a pickup handling fee for the canceled order.

Same-Day Select

BJ’s SDS is a membership add-on where you prepay for one year of eligible same-day deliveries (not to exceed two deliveries per day). BJ’s members with an active SDS package have prepaid for eligible same-day deliveries, and therefore see a $0 delivery fee for eligible same-day delivery orders placed on BJs.com or the BJ’s mobile app. SDS packages are shared between primary and household members. Either the primary or the household member may purchase an SDS package, but there can only be one SDS package between them. Supplemental and business members are excluded. Your SDS package applies only to orders placed with your membership and may not be transferred or assigned.

SDS orders must include $50+ (after discounts, before taxes) of same-day delivery eligible products, and SDS benefits are limited to two deliveries per day. If only some items in your order are eligible for SDS, you will pay delivery or shipping charges, as applicable, for the ineligible items.

SDS benefits are not available (i) in all ZIP codes, (ii) for commercial addresses, P.O. boxes, or APO, FPO or DPO addresses, (iii) for certain oversize, heavy, and high-value items and orders, and (iv) on certain holidays and high-volume shopping days. In addition, SDS benefits do not include priority delivery or other enhanced delivery features. Availability of SDS benefits is subject to inventory and delivery personnel availability. Eligible orders exclude orders in-club at BJ’s front-end registers; BJ’s services; sales tax, bottle deposits; tobacco; lottery; gift cards; propane; BJ’s Gas; online optical; membership fees and add-ons (e.g., shipping, delivery, pick-up fees); third-party services (e.g., BJ’s Travel, warranties); B2B and Global Sales.

BJ’s may terminate your SDS package at any time, for any or no reason, without notice. Upon such termination you will be entitled to a prorated refund of the SDS fee unless the termination is related to conduct that BJ’s determines, in its sole discretion, violates these Delivery Terms or any applicable law, involves fraud or misuse of SDS, represents a safety or reputational concern, or is otherwise harmful to BJ’s, its members, team members, or service providers or partners. BJ’s failure to insist upon or enforce your strict compliance with these Delivery Terms will not constitute a waiver of any of BJ’s rights.

You may cancel your SDS package at any time. If you cancel your SDS package within fifteen (15) calendar days of purchasing the SDS package and have not utilized any SDS benefits, you will be entitled to a refund of the SDS fee. If you cancel your SDS package at any other time, or after you have utilized any SDS benefits, you will be entitled to a prorated refund.

SDD Benefit terms (The Club+ Card and The Business Club+ Card)

For The Club+ Card and The Business Club+ Card Memberships, “eligible orders” are purchases of goods on BJs.com or in the BJ’s mobile app which include items eligible for same-day delivery through your SDD Benefits. Same-day delivery through your SDD Benefits is not available (i) in all ZIP codes, (ii) for commercial addresses, P.O. boxes, or APO, FPO or DPO addresses, (iii) for certain oversize, heavy, and high-value items and orders, and (iv) on certain holidays and high-volume shopping days. In addition, SDD benefits do not include rush delivery or other enhanced delivery features. Eligible orders exclude orders in-club at BJ’s front-end registers; BJ’s services; sales tax, bottle deposits; tobacco; lottery; gift cards; propane; BJ’s Gas; online optical; membership fees and add-ons (e.g., shipping, delivery, pick-up fees); third-party services (e.g., BJ’s Travel, warranties); B2B and Global Sales.

SDD Benefits are automatically applied to your first two (2) eligible orders of $50 or more (after discounts and before taxes) during the applicable annual membership period, when you select same-day delivery for your order. When your SDD Benefits are applied to an eligible order, special handling and service fees, rush and other enhanced delivery fees, taxes, and tips may still apply. If only some items in your eligible order are eligible for same-day delivery through your SDD Benefits, you will pay delivery or shipping charges, as applicable, for the ineligible items.

SDD Benefits must be used within the annual membership period in which they were first available to you. If you do not use the SDD Benefits within such annual membership period, or if your membership is downgraded, expires, or is canceled for any reason, all unused SDD Benefits will be automatically forfeited. You will not be entitled to and will not receive any compensation from BJ’s for SDD Benefits that are forfeited. To the extent allowed by applicable law, BJ’s may cancel any outstanding SDD Benefits if BJ’s becomes insolvent, unable to pay its debts when due, files an action under the U.S. Bankruptcy Code, or has such an action filed against it. If you believe BJ’s failed to properly credit you with SDD Benefits, you must make a claim for such missing SDD Benefits within ninety (90) days of the date on which the applicable annual membership period commenced. Any missing SDD Benefits not claimed within such time period will be forfeited.

If you renew your membership prior to the last day of the month/year shown on your receipts and BJs.com account (“Original Expiration Date”), your SDD Benefits for such renewal period will become available to you on the first day of your membership renewal period (i.e., the day following the Original Expiration Date). In no event may any person, business, or membership receive more than two (2) same-day deliveries with no standard delivery fee as part of SDD Benefits during any annual membership period.

Returns and refunds of your BJ’s purchases, including eligible orders, are subject to BJ’s return policy. If you make a return on a purchase on which you redeemed SDD Benefits or improperly reject or fail to timely and properly accept same-day delivery for such purchase, your SDD Benefit will not be reinstated or otherwise credited to your membership account.

Availability of same-day delivery services is not guaranteed. SDD Benefits cannot be sold, purchased, brokered, bartered, transferred, or altered in any way by you. Any attempted transaction of such sort will automatically be void. Anyone engaging in such transactions will be liable for damages to BJ’s, including, but not limited to, consequential damages, third-party damages, transaction costs, attorney’s fees, and court costs. Any violation of these provisions may, among other things, result in termination of your BJ’s membership and forfeiture of unused SDD Benefits. BJ’s reserves the right to verify and adjust your SDD Benefits balance at any time. SDD Benefits are applied to the primary member’s account only and cannot be combined from multiple memberships; however, SDD Benefits may be redeemed by the primary member or the associated (i) household member, for The Club+ Card Membership, and (ii) complimentary supplemental member, for The Business Club+ Card Membership.

Third-Party Services

Same-day delivery services may be performed by third parties, which include, independent contractors and third-party logistics providers (collectively, “Third-Party Providers”). You acknowledge that Third-Party Providers are not BJ’s employees. You further acknowledge that BJ’s does not supervise, direct, or control the performance of services provided by Third-Party Providers to you or for your benefit.

Agreement Changes

BJ’S MAY CHANGE THESE DELIVERY TERMS AT ANY TIME, WITHOUT NOTICE TO YOU. YOU AGREE TO PERIODICALLY REVIEW BJ’S DELIVERY TERMS FOR ANY SUCH UPDATES. IF ANY CHANGE IS FOUND VOID OR UNENFORCEABLE, THAT CHANGE IS SEVERABLE AND DOES NOT AFFECT THE VALIDITY OF THE REMAINING TERMS. YOUR CONTINUED USE OF BJ’S PICK UP IN-CLUB, CURBSIDE PICKUP, AND/OR SAME-DAY DELIVERY SERVICES AFTER BJ’S CHANGES THESE DELIVERY TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO SUCH CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP AND, IF APPLICABLE, SDS PACKAGE.
